The parties involved seek the ruling of a Magistrate or Judge who will make a decision based on the evidence presented and the applicable law.
Litigation can be a lengthy and expensive process, often requiring the services of attorneys, expert witnesses, and other legal practitioners. It typically involves a series of legal procedures, including the issuing of a summons or application, conducting discovery (the process of gathering evidence), participating in pre-trial conferences, and presenting evidence and arguments in Court.
Litigation is said to be an adversarial process but it can also be a means of resolving disputes in a fair and just manner, with the court system providing a neutral forum for parties to present their cases and have their grievances addressed.
